ARTICLE 1 – PREAMBLE


These general terms and conditions of sale, detailed below, govern the contractual relations
between a Customer using the "PLANCHAELEC.COM" website who wishes to make
a purchase from our company via the "PLANCHAELEC.COM" website belonging to
the company SOCIETE NOUVELLE DE MONTAGE INDUSTRIEL-SNMI, a simplified joint stock company with capital of 300,000 euros, having its registered office in MIRIBEL (01700), Rue des
Brotteaux – Z.I., registered with the BOURG EN BRESSE Trade and Companies Register under number 309674091.
Since sales via the website are similar to mail order sales, the provisions
referred to in Articles L. 121-16 et seq. of the Consumer Code are applicable to
Consumers.


Each purchase on the Site is governed by the general terms and conditions applicable on the date of the
order. The customer may only confirm their order after having read these
general terms and conditions and having accepted them by checking the icon provided for this purpose.
The customer acknowledges that by confirming their order, they unreservedly accept the
general terms and conditions of sale after having duly read them.
By confirming these general terms and conditions of sale when ordering, the customer declares
that they have the legal capacity to conclude a contract within the meaning of Articles 1123 et
seq. of the Civil Code.


ARTICLE 2 – PRODUCTS


2.1 PRODUCT INFORMATION


In accordance with Article L. 111-1 of the French Consumer Code, "PLANCHAELEC.COM"
specifies with the utmost rigor the information posted online and concerning the
essential characteristics of the products, notably thanks to technical descriptions, and this,
within the limits of technology and in compliance with the best market standards.
However, the photographs of the products posted online are in no way contractual.

2.2 SCOPE OF MARKETING


The products offered comply with the legislation and standards applicable in the
European Community.
If the customer is domiciled outside the European Community, it is their responsibility
to check with local authorities regarding the import possibilities of the products in question.
If the customer does not comply with the country's legislation, "PLANCHAELEC.COM" cannot be held responsible.

ARTICLE 3 – ORDERS


3.1 INFORMATION WHEN ORDERING


It is the customer's responsibility to verify the completeness and accuracy of the information they
provide when ordering, particularly the spelling of their name and the delivery address.
"PLANCHAELEC.COM" cannot be held responsible for any data entry errors or the resulting consequences.
In this context, the costs incurred for reshipping the order would be borne by the
Customer.
The data provided by the Customer and recorded by "PLANCHAELEC.COM" during
registration and ordering constitute proof of transactions between
"PLANCHAELEC.COM" and the Customer.


3.2 ​​AVAILABILITY OF PRODUCTS


Products are shipped within 48 to 72 hours. All our products are in stock
but if the ordered product is unavailable, the Customer will be informed as soon as possible and
will have the option to cancel their order. The Customer will then have the option of requesting a
refund of the amounts paid within 30 days at the latest of their payment, or
exchanging the product.


ARTICLE 4 – PRICES


Prices are indicated in EUROS, including VAT, ex-works, and are only valid on the date the order is
validated by the customer.
A shipping charge of €20 applies to any order under €400.
Free shipping applies to any order over €400.
The price of certain products may be increased by the amount of the eco-contribution in accordance with Decree No. 2005-829 of July 20, 2005, relating to the composition of electrical and electronic equipment and the disposal of waste from this equipment.
Payment of the full price must be made at the time of ordering. At no time may the amounts paid be considered as a deposit or down payment.


ARTICLE 5 – PAYMENT METHOD

"PLANCHAELEC.COM" reserves the right to suspend any order processing and
any delivery in the event of refusal of authorization for payment by bank card from
officially accredited organizations.

ARTICLE 6 – RETENTION OF TITLE


"PLANCHAELEC.COM" retains full ownership of the products for sale until the amounts due (taxes, delivery charges, and miscellaneous fees) have been properly collected.


ARTICLE 7 – DELIVERY TERMS


7.1 DELIVERY TIME


In accordance with Article L. 121-20-3 of the French Consumer Code, before confirming the order, "PLANCHAELEC.COM" will inform you of the delivery deadline, which is generally 48 to 72 hours. Every effort is made to ensure that the products ordered are delivered within the specified timeframe. In the event of an extension of the delivery time beyond its control,
“PLANCHAELEC.COM” undertakes to notify the Customer as soon as possible in order to allow them to decide whether to maintain or cancel their order.


If the delivery date is exceeded by more than 14 days compared to the agreed deadline,
and if this delay is not due to force majeure, the Customer may cancel the
sales contract by email and a registered letter with acknowledgment of receipt addressed to: SNMI – BP
80134 – 01700 MIRIBEL (Article L. 114-1 of the French Consumer Code). The sale will then be considered canceled unless the shipment has taken place before receipt of the email
or the registered letter with acknowledgment of receipt.


An order may consist of several packages delivered at the same time.
In the event that the ordered products are delivered on different dates, taking into account
their availability, the delivery time is based on the longest delivery time.


7.2 DELIVERY PLACE


Products can only be shipped within mainland France.
Please note that for other countries, Monaco, and Corsica, please make a specific request by email.


7.3 DELIVERY ACCEPTANCE


The Customer agrees to be present on the agreed delivery date and to verify the conformity of the order upon receipt. If the Customer is not present on the delivery date, reshipping costs will be charged. Delivery "to the foot of the building"

ARTICLE 8 – RIGHT OF WITHDRAWAL


Pursuant to Article L 121-20 of the French Consumer Code, the Customer has 14
working days from the date of receipt of their order to return a product they are not satisfied with to
"PLANCHAELEC.COM". Return the product with its

All returns must be reported to our customer service by email (contact@planchaelec.com)
or mail (SNMI – RUE DES BROTTEAUX - BP80134 – 01700 MIRIBEL). The return costs
are the responsibility of the Customer.
"PLANCHAELEC.COM" will reimburse the customer for the full amount paid when
ordering as soon as possible and at the latest within 30 days following the date on which
the right was exercised.
ATTENTION: Only products in new and complete condition (accessories,
instructions, etc.) returned in their original packaging will be accepted. Any product that has been damaged or
used and whose original packaging has been damaged in conditions exceeding its simple
opening, will not be refunded or partially refunded.
The legal guarantee (Article 1641 of the Civil Code) does not apply to the repair of damage
resulting from a cause external to the product (e.g.: shock caused by a third party or the Customer, object
fallen on the product causing a shock or breaking the object of the order, incompatibility
with the electricity network) or due to the customer.


9.1 NON-COMPLIANCE OF THE ORDER OR DEFECTIVE PRODUCT


In the event of a non-compliant product, the Customer may submit a complaint by email
(contact@planchaelec.com) or by post (S.N.M.I – BP80134 – 01700 MIRIBEL). The Customer is
requested to describe the reasons for the non-compliance in detail.
"PLANCHAELEC.COM" grants a 7-calendar-day cooling-off period to
return any non-compliant or defective item. After receiving the products and checking
for non-conformity or defects, the return costs will be refunded within a maximum of 30
days and "PLANCHAELEC.COM" will arrange a new shipment.
PLEASE NOTE: The Customer must contact "PLANCHAELEC.COM" to benefit
from the right of return and obtain their agreement.


9.2 SCOPE OF THE WARRANTY


All electrical products are sold with a 2-year warranty for domestic use only and for use in accordance with professional standards, with strict adherence to technical specifications and safety instructions. A special 5-year warranty is applied to the griddle cooking plates (against breakage, cracks, and perforations). The Customer must ensure, before using the product, that it is suitable for its intended use.
The warranty is limited to the replacement of defective parts, subject to agreement with
PLANCHAELEC.COM, and is not liable for any accidents to persons or property that may result.
The warranty does not apply to:
-If the product has not been used in the conditions for which it was built.
- In the event of deterioration or accident resulting from negligence, lack of maintenance or
supervision.
- If the product has been transformed or repaired by unauthorized persons.
- If the nameplate has been falsified, altered, made illegible or removed.
- For damage caused by a non-compliant electrical installation.
- For damage caused by lightning, fire, excess water or any excessive
climatic conditions.
- For normal wear and tear of the equipment (scratches on the hob, possible deformation
of the hob)

- The warranty will not apply if the equipment is used in a professional, industrial or collective manner.


ARTICLE 10 DISPUTE AND LIABILITY


The choice and purchase of goods by the Customer are under his responsibility.
Consequently, the total or partial impossibility of using the products, in particular due to
material incompatibility or electrical incompatibility, cannot give rise to any
compensation, reimbursement or questioning of the liability of
"PLANCHAELEC.COM", except in the case of a proven hidden defect, non-conformity,
defect or exercise of the right of withdrawal provided for by the Consumer Code.
"PLANCHAELEC.COM" cannot be held responsible for non-performance of the contract
in the event of stock shortage or unavailability of the product due to a case of force majeure,
disruption or total or partial strike of transport, postal and/or
communication services."PLANCHAELEC.COM" cannot be held responsible for any indirect damages that may arise from the purchase of products.
PLANCHAELEC.COM" disclaims any liability for the content of sites to which hyperlinks may be directed from its own site.
"PLANCHAELEC.COM" disclaims any liability for accidents occurring to people as a result of
improper use of the equipment (including lack of maintenance,
disassembly, improper connection, or products placed in the hands of children or non-responsible persons).

Customer has the right to access and rectify their data and may exercise
